These Terms of Service (“Terms”) govern your access to and use of bar-smart.com (the “Site”), a domain owned by SuperDocs LLC (“SuperDocs,” “we,” “us,” or “our”) that hosts landing pages for special offers to members of professional organizations (e.g., bar associations and trade groups). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms are specific to bar-smart.com. If you click through to create an account, start a trial, or purchase on superdocs.com or in the SuperDocs app, those activities are governed by the SuperDocs Terms of Service and related policies posted there.

2) Eligibility & your promises

You must be at least 18 years old and legally able to agree to these Terms. You agree that any information you provide (e.g., name, email, phone, bar number/member ID) is accurate and that you’ll use the Site in compliance with law.

3) Purpose of the Site (offers & verification)

The Site presents targeted offers for members of professional organizations. We may ask for limited details (e.g., association name, bar number, member ID, referral codes) solely to confirm eligibility and tailor the offer experience. In some cases, we may direct you to your organization or a verification partner to validate membership; we only disclose the minimum necessary information for that validation, or we’ll have you complete verification directly. 4) No legal advice

Content on the Site is for informational and promotional purposes only and is not legal advice. You should consult a qualified attorney for legal advice. (The SuperDocs ToS similarly disclaims tailored regulatory compliance and specialized uses.)

5) Using our Site & IP rights

We own or license all rights in the Site’s content, designs, text, graphics, logos, and underlying software. We grant you a limited, revocable, non-transferable license to access and use the Site for its intended purpose: viewing and responding to offers. You may not copy, scrape, republish, or commercially exploit the Site or its content without our written permission.

6) Prohibited activities

You agree not to: (a) interfere with or attempt to bypass security or access controls; (b) collect data from the Site via automated means; (c) misrepresent eligibility or identity; (d) use the Site in violation of law; or (e) upload or transmit defamatory, fraudulent, infringing, or harmful content.

7) User submissions & feedback

If you send us ideas or feedback about offers or the Site (“Submissions”), you grant us the right to use them without restriction or compensation, and you represent you have the right to share them.

8) Third-party links & handoffs

The Site may link to external sites (e.g., association portals, verification partners, superdocs.com checkout). Those sites are not controlled by us; their terms and privacy policies apply. We aren’t responsible for their content or practices.

9) Changes, availability, and updates

We may change, suspend, or discontinue the Site (or any offer) at any time. We don’t guarantee continuous availability and aren’t liable for downtime or interruptions. We may update these Terms; your continued use after updates means you accept the changes.

10) Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. We don’t warrant that the Site will be error-free or secure, or that third-party links will be accurate or safe.

11) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE (AND OUR DIRECTORS, EMPLOYEES, AND AGENTS) WON’T BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUE/DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SITE.
Where a cap is required, our total liability for any claim related to your use of the Site will not exceed US $100 (or, if applicable and more favorable to you, the amount stated in the SuperDocs ToS for services you actually paid for on superdocs.com).

12) Indemnification

You agree to defend, indemnify, and hold us harmless from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your breach of these Terms, or your violation of any law or third-party rights.

13) Electronic communications & consent to be contacted

By submitting a form on the Site, you consent to receive emails (and, if you provide a phone number, calls or texts) regarding the offer and related SuperDocs services. You can opt out of marketing emails at any time via the unsubscribe link; opting out may not affect transactional messages (e.g., eligibility confirmations). (Electronic communications and e-signatures are recognized in the SuperDocs ToS.)

14) Governing law; dispute resolution

These Terms and your use of the Site are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Before filing a claim, both parties agree to try to resolve disputes informally for 30 days after written notice. If unresolved, disputes will be resolved by binding arbitration under the American Arbitration Association (AAA) rules, with venue as specified by the AAA rules consistent with Texas law, and no jury trial. Class actions and class arbitrations are waived to the fullest extent permitted by law. (Some disputes may be excluded as provided in the SuperDocs ToS.)

15) Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you’ve violated these Terms or used the Site unlawfully.

16) Miscellaneous

These Terms are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision isn’t a waiver. You may not assign these Terms without our consent; we may assign them.
